CAR RESERVATION RULES
“Car reservation rules” (hereinafter – Rules) is a legally binding document, which establishes mutual rights, duties and liability of a Customer (hereinafter – Customer) and JSC „Autoalėja“, company code 300810509 (Autocenter “TRAUKA”) (hereinafter – Autocenter) when Client reserves preferred to buy car on the website www.trauka.eu.
In agreement with the terms of the Rules, the Customer confirms that:
1. Has acquainted with all the terms of the Rules;
2. The terms of the Rules are completely clear and understandable;
3. Does not consider the terms of the Rules discriminatory and/or providing a significant advantage to Autocenter;
4. Is aware that if the Customer refuses to purchase the car he has reserved, the reservation fee will go to Autocenter and will not be returned to the Customer;
5. Agrees with all the terms without exception and commits to comply with them.
The Customer reserves preferred to buy car and pays the reservation fee of 500 LTL to Autocenter, using links „RESERVE ONLINE” on the website www.trauka.eu, which is owned by Autocenter, and Autocenter reserves preferred to buy car for the Customer up to 7 days from the reservation fee payment day.
The Customer has a right:
1. To reserve preferred to buy car according to the terms laid down in the Rules and the website www.trauka.eu;
2. The Customer that has paid the reservation fee has a priority right to purchase the reserved car within 7 days from the reservation fee payment day.
The Customer commits:
1. To pay the reservation fee of 500 LTL when reserving a car;
2. To follow the Rules, other terms, clearly specified on the website www.trauka.eu, and not to violate the laws of the Republic of Lithuania when reserving a car.
Autocenter has a right:
1. Not to return the reservation fee to the Customer, if the Customer refuses to purchase the reserved car;
2. To amend the Rules unilaterally (partly or completely);
3. To suspend temporarily or terminate the car reservation service at any time and without notice to the Customers.
Autocenter commits:
1. To allow the Customer to reserve the preferred to buy car online under the terms and procedures of the Rules;
2. Not to transfer the car reserved by the Customer to other Customers as long as the reservation of the initial Customer is valid;
3. Not to use the reserved car for test drives or any other purposes;
4. If the Customer takes advantage of the priority right to purchase the reserved car, the reservation fee is figured in by Autocenter as a partial payment for the reserved car.
The Customer is fully responsible for all actions performed using the car online reservation service.
The Customer is fully responsible for all actions performed on the online banking websites referred to on the website of Autocenter and for any actions of the third parties performed on the online banking websites using the Customer’s passwords and/or identification codes.
Autocenter is not responsible for any consequences that resulted from the breach of the terms of the Customer’s use of the car online reservation service.
Autocenter is not responsible for any troubles using the car online reservation service, which resulted from the troubles using the online banking websites referred to on the website of Autocenter.
Autocenter is not responsible for any troubles using the car online reservation service, if it is not the fault of Autocenter.
If the links to the websites of other companies, institutions, organizations or individuals are on the website www.trauka.eu, Autocenter is not responsible for the information contained therein or carried out activities, does not monitor or control these websites and does not represent those companies and individuals.
In case of damage, the guilty party compensates the direct loss of other party.
The Rules are subject to the law of the Republic of Lithuania.
All contentious issues are resolved by mutual agreement. If no agreement is reached – in the court of the Republic of Lithuania under the legal procedures established by the laws of the Republic of Lithuania.
